Terms of Service

These Terms govern your use of diypr.in, operated by StartupTalky. By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 and authorised to bind any organisation you represent.

2. What DIYPR does

DIYPR helps you discover journalists, draft personalised outreach emails with AI assistance, send them from your own Gmail, and track opens/replies/coverage. DIYPR is a tool; it does not guarantee press coverage.

Violations lead to suspension or termination. No refund.

4. Your content

You retain all rights to your press releases, pitches, and uploaded contacts. You grant us a limited license to store and transmit that content solely to operate the Service for you.

5. Master Journalist Database

The DIYPR Master Journalist Database is our proprietary compilation. You may use entries only inside the Service to send individual, personalised pitches. You may not export, resell, share, scrape, or bulk-download entries.

6. AI-generated content disclaimer

AI drafts may contain errors, fabricated quotes, or inaccurate claims. You are 100% responsible for what you send. Always review an AI draft before clicking Send.

7. Third-party services

Gmail use is governed by Google's terms. We are not responsible for Gmail outages, sending limits, or account issues. AI output quality is not guaranteed.

9. Service limits

Each plan has a pitch cap. Gmail also enforces its own sending limits (500/day free Gmail, 2,000/day Workspace). DIYPR cannot exceed these.

10. Availability

We aim for 99.5% uptime. No SLA on the Starter plan. If the Service is fully unavailable for more than 5 consecutive days, contact support for a credit.

11. Termination

You may cancel any time. We may terminate for Terms violations, non-payment, or product discontinuation. On termination, data is deleted per the Privacy Policy retention schedule.

12. Liability

The Service is provided “as is”. We disclaim all implied warranties. We are not liable for lost coverage, lost business opportunities, Gmail issues, AI inaccuracies, or consequential damages. Total liability is limited to the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You indemnify us against claims arising from your use of the Service, your content, or your Terms violations.

14. Governing law

These Terms are governed by the laws of India. Courts of [City TBD — Bengaluru or Mumbai, fill before launch] have exclusive jurisdiction.

15. Changes

We may update these Terms; material changes are emailed. Continued use means acceptance.
